Big Fish Social Casino Targeted by New Class Action Lawsuit in Washington State

Seattle-based social casino Big Fish is facing a fresh class-action lawsuit that accuses it of operating “illegal online casino games.”
The play-money site was hit by several similar lawsuits last year after a federal court in Seattle ruled that the virtual chips used in Big Fish’s casino games could be considered to be “something of value,” which meant they could be defined as gambling under Washington State law.
The state defines gambling as “risking something of value on the outcome of a contest of chance or a future contingent event not under the person’s control or influence to receive something of value in the event of a certain outcome.”
Big Fish to Fry?
The new suit names Big Fish’s former owner, Churchill Downs, and new owner, Aristocrat Technologies, as defendants. The social games developer was acquired by Australian slots manufacturer Aristocrat in January 2018 — three months before the court’s ruling — for almost $1 billion.
While Big Fish’s games are ostensibly free to play, extra chips can be acquired through in-app purchases.
Curiously, the new lawsuit accuses Big Fish of using practices similar to casinos to reap “huge profits” while never paying out anything of monetary value — an accusation that appears to be self-defeating, since the virtual chips players win must have “value” in order to be considered gambling.
As we allege in our complaint, the mobile gambling industry, by design, preys on consumers by bringing additive gambling opportunities directly into their homes,” Christopher Dore, an attorney representing the plaintiff, Florida resident Manasa Thimmegowda, told Komo News.
“We look forward to proving that companies are aware that many of their customers fall victim to these gambling games, with significant negative impacts on their lives financially and otherwise.”
Appeal Expected
The original case against Big Fish was brought in 2015 by former player Cheryl Kater, who claimed she had spent $1,000 topping up chips on the site. She argued Big Fish violated several Washington State statutes, including the Recovery of Money Lost at Gambling Act and the Washington Consumer Protection Act.
The case was tossed in 2016, but Kater appealed. The resulting verdict was a shock to the social gaming industry and could have ramifications not just for social casinos but for any game that employs microtransactions and an element of chance.
In April last year, Aristocrat vowed to work with Churchill Downs to appeal the verdict, emphasizing there were?“meritorious legal and factual defenses against [Kater’s] allegations and requests for relief.”

A new lawsuit should be filed. 2023 and they are up to the same dirty tricks. The higher tier you are, the less it pays. My mom plays but never purchases fake coins and she has several billion fake coins. I am a level 9, I have paid but stopped doing that after I realized it was rigged. I barely get wins and when I do, they immediately take everything back. I reported this to Apple and in a couple days they gave me a refund.

I was just banned from playing Big fish as well as Jackpot city with absolutely no reason given. I spent over $9000 on the month of March, and they closed my game the day before my VIP bonus, which would be HUGE, was supposed to be credited. I have emailed customer support, no answer. The CEO, no answer and Aristocrat, No answer. I broke NO rules to cause a suspension of either account. I asked for them to either reinstate my game WITH my VIP bonus or refund the over 9k spent. NO ANSWER! How is this legal? How can they take a players money and close the account the day before giving them thier played for VIP bonus??? Please inform me how to retain your law services,I will NOT let this go quietly! This is pure theft!!! Kimberly
Just weird after a Lawsuit how many come up and say they are victims,without the Lawsuits no one ever mentioned that,in 2020 human should be so smart to see this and have enough brain to know that this is luring and cheat for trick to pay,im a player too but fortunate i not was that dumb to pay any. On other War games and else the people spend much more cash and just because it is Strategy and War no one claims to be a victim even the developers want the same thing -MONEY If someone open a Lawsuit against War games all Enthusiasts and Dedicated Players will come and say im a victim just because someone told them to be a victim,sorry but first playing Big Fish and pay any is dumb and if a Lawsuit applied all claims to be a victim is even dumber ,sorry to say,this is just ridiculous dumb
I woukld like this casino is the most ashame, pathethic and ridiculous casino. No mater if i bought or not this casino just collect and collect our fake chips all the time !!!!!!!! Plus when i sent a email to vip Team we have no answer ( send us an automatic email and told us to if we have a problem to replay and when we replay recived again this ridiculous automatic emails ??? I have played this game off and on for a couple of years and have never purchased anything. I can play for hours and have never lost all of the free chips they give. In fact I usually have won more than I've lost. There is nothing making me buy chips so I don't. I always bet the minimum bet size as I don't see any reason to play more. My enjoyment of the game doesn't change if I bet more chips so I don't. If I ever run out of chips I can go play a different game. I have never had anyone ask me to buy chips or promise me anything and I just ignore the ads where they try to sell you more chips. While I understand many people think they are preying on the weak or susceptible if you fall into that category then those people need to make sure you know exactly what they get for their money before they pay money. Darn near every game uses the buy to get farther model or wait X amount of time before continuing to play. I choose to play many games and if I have to wait until tomorrow to get more free chips so be it.
I am a disabled veteran and am mostly housebound and these games help me with my PTSD. I have lost thousands and as your account ages the more you lose over and over Again. I really need help to recoup my lose income. Any help would be great
